4.12. LOSS OF USE
Loss of use of tangible property which has not been physically injured or destroyed resulting from :
4.12.1 a delay in or lack of performance by or on behalf of the Insured of any contract or agreement,
4.12.2. the failure of the Insured’s Products to meet the level of performance, quality, fitness or durability expressly or impliedly warranted or represented by the Insured.
It is also noted & agreed that the above Exclusion is only applicable to Product Liability arising out of export of “envirocoal” only to USA/Canada.
